Amicable Settlements

Whenever a right has been trampled upon or a wrong was done, the first reaction is to find a lawyer and then sue the person, or corporation who caused it.

One you have decided to do so, it’s not that difficult to find a lawyer that will bring your cause to court.

Well, as long as you have the money to pay the consultation fees, acceptance fees and all other professional fees that the lawyer will charge you.

After this, you’ll find yourself in a multitude of proceedings until you realize that it’s been months or even years and there still has yet to be a final determination of your case in sight.

We live in a litigious society. It is unfortunate that rules which are in place such as conciliation, mediation and dispute resolution have merely become steps that litigators go through in order to comply with the necessary condition precedent and avoid a dismissal of the case.

Efforts in achieving true amicable settlements between parties have so often been overlooked. Parties are ready to gnaw at each other during these meeting that the process seems more like a formality that a tool to for compromise.

Sure some would say that there are cases which are beyond compromise but this is where the brilliance of lawyers come into play.

Their ability to present a situation that will result to both parties agreeing to settle their differences without the need for further court proceedings is what makes them worthy officers of the court.
